Turn the motor off and then turn the key on and it shifts fine, of course by rocking it back and forth. tried 4-5 times with same result. If the shifter gears were gummed up it would seem it wouldn't shift with the engine either on or off. Once it warms up a bit it seems to be fine.

Honda 2002 and up ES and all Rubicon models use codes to identify shift and tranmission problems. The codes are different for each type/model so make sure you are following the correct procedure; ES models are listed first, followed by the Rubicon First thing to check is the volage from the battery. It should be a minimum of 12.4 volts.
My advice is to yank the shift motor, remove the reduction gears, and then reinstall the shift motor (to keep water out of the engine) and then weld on the emergency shifter (or better, swap in a footshift spindle and shifter).
